An open letter to any people that I interview in the future

You do have a right to record an interview that I do with you, provided that I consent. Please don’t be like the folks at Promiscuous Bullet in their Oct. 29 podcast, where they broadcast their non-consenual recording of my interview with them.

I wouldn’t have so much a problem with this if they’d asked me if they could record, and then asked me if they could podcast it. The interview doesn’t have anything bad, revealing or salacious in it, but it’s just common courtesy.

Not only is asking people if you can record them a good idea — it’s the law (in Washington and several other states):

RCW 9.73.030

Intercepting, recording, or divulging private communication — Consent required — Exceptions.

(1) Except as otherwise provided in this chapter, it shall be unlawful for any individual, partnership, corporation, association, or the state of Washington, its agencies, and political subdivisions to intercept, or record any:

. . .

(b) Private conversation, by any device electronic or otherwise designed to record or transmit such conversation regardless how the device is powered or actuated without first obtaining the consent of all the persons engaged in the conversation.
